Turned away at the gate? Don't pay per diem for it.

Objective proof of appointment freezes, empty-return refusals, chassis outages and turn times, tied to every per diem day billed.

§ 545.5

the Commission weighs empty-return availability when judging whether detention is reasonable

Recommended plan: Recovery Starter

The problem

Where drayage carriers lose money.

  1. Empties

    Empty returns refused

Your driver arrives with the empty and the terminal is not accepting that size and type. Per diem keeps running.

  2. Appointments

    No slots to book

The appointment system shows nothing for days. The steamship line bills per diem anyway.

  3. Chassis

    Chassis outages and splits

No chassis at the terminal or a split you could not avoid. The record exists in your dispatch system but never reaches the dispute.

  4. Pass-through

BCOs and lines push charges down

Per diem is billed to you under interchange terms even when the delay sat with the terminal or the line.

The approach

Your dispatch data, turned into evidence.

ATAHSKIA connects to your drayage TMS and GPS feeds and pairs each per diem day with what your trucks and the terminal actually did: arrival at the geofence, the turn-away, the appointment snapshot, the empty-return notice.

Per diem invoices are checked against the billing rule like any other, and each disputed day carries its timestamped evidence.

  • Geofence arrival and departure times per terminal
  • Turn-away and empty-refusal capture
  • Appointment availability snapshots
  • Chassis outage evidence from pool notices

“We used to eat per diem every time an empty got refused. Now the refusal notice, the GPS stamp and the appointment screenshot go out with the dispute.”

Questions from drayage carriers

Is there a drayage-specific plan?

Most carriers start on Recovery Starter. Fleets with high per diem volume can talk to sales about a dedicated per diem package.

Which TMS platforms do you connect to?

PortPro natively, plus CSV and API ingestion for other drayage systems. GPS data can come from your ELD provider exports.

Can a motor carrier be billed for D&D at all?

Whether a party is a proper billed party depends on the facts. Every invoice must state the basis for why the billed party is liable under § 541.6(a)(4); ATAHSKIA flags invoices that omit it.
