The port at a glance
The Port of Wilmington is owned and operated by the North Carolina State Ports Authority. Its container terminal on Shipyard Boulevard has a 42-foot channel, nine berths with 6,768 feet of wharf, seven container cranes (four post-Panamax and three neo-Panamax) and a stated capacity of 600,000 TEU. A rebuilt South Gate container complex with weigh-in-motion scales and scanning opened in February 2022, alongside a move to the Navis N4 terminal operating system. CSX provides intermodal rail service, including the Queen City Express link toward Charlotte, and the port's cargo base mixes retail imports, furniture, refrigerated goods, forest products and resins.
Wilmington is a smaller, mid-Atlantic gateway with a defined weekday gate window, and that shapes how D&D accrues. The container gate runs Monday through Friday, so a container that becomes available on a Friday afternoon may not be retrievable until Monday, and weekend days can be billed against free time. Container volumes have been more volatile than at the larger Southeast ports, with service changes shifting cargo between Wilmington and neighboring gateways. Refrigerated cargo has grown to a larger share of the port's volume, adding USDA hold exposure. Hurricanes are the other recurring disruption: storms reaching the Cape Fear coast close the port for days.
The mistake importers make most often at Wilmington is counting free time in calendar days without checking whether the gate was open. Free-time rules vary by billing party, and some tariffs or contracts count calendar days while others exclude weekends and holidays. If the invoice does not state the rule and the free-time start and end dates required by 46 CFR § 541.6, there is no way to check it, and under § 541.5 the billed party is not obliged to pay.

Appointments & empty returns
- The container gate operates Monday through Friday, 7:00 a.m. to 6:00 p.m., with 5:30 p.m. as the last time to receive containers; reefer delivery and receipt run on shorter windows (NC Ports, Port of Wilmington page).
- NC Ports' Customer Access Portal provides terminal information, including holiday gate schedules, and the terminal runs on the Navis N4 terminal operating system.
- NC Ports publishes operational updates and gate changes on ncports.com, which are the reference for closures and outages on a billed date.

Weekday-only gate window
With a Monday to Friday container gate and a 5:30 p.m. last receive, containers available late in the week can sit through a weekend. Check whether the governing tariff or contract counts weekend days against free time and whether the invoice applies that rule correctly.
Hurricane closures
Atlantic hurricanes regularly threaten the Cape Fear coast, and NC Ports closes terminals ahead of major storms. Closure and reopening notices establish days that cannot fairly count against free time.
Systems outages
NC Ports has experienced systems-wide outages that delayed gate operations. Outage notices are direct evidence that containers could not be moved during the affected hours.
Reefer holds and shorter reefer windows
Refrigerated cargo has become a larger share of Wilmington's volume. Reefer delivery and receipt run on narrower hours than the main gate, and USDA holds can delay availability.
Service changes
When carriers add or drop Wilmington calls, cargo can be discharged elsewhere and trucked or railed, or rolled to a later vessel. Rolled export bookings and diverted imports often carry D&D the cargo owner did not cause.
Free time and disputes at Wilmington (NC)
At Wilmington, NC Ports bills terminal charges under its published tariff, and ocean carriers bill demurrage and detention under their tariffs or service contracts. Free time and whether weekends or holidays count are set in those documents, not by the port as a whole. Each invoice must state the applicable rule, the free time in days, the free-time start and end dates, the container availability date and the specific dates charged under § 541.6, and where those elements are missing, § 541.5 eliminates the obligation to pay.
When the invoice is complete, compare it with the gate calendar. Identify every chargeable day on which the container gate was closed (weekends, holidays, hurricanes and outages) and check whether the governing rule excludes them. Compare the availability date with hold release times, particularly for reefers. For detention, confirm the empty could actually be returned on each billed day. Days when the gate was closed or a hold blocked the move are the core of an incentive-principle argument under 46 CFR § 545.5.
Each invoice carries its own 30-day clocks. The billing party must issue within 30 calendar days of when the charge was last incurred (§ 541.7), and the billed party has at least 30 calendar days from issuance to request mitigation, refund or waiver (§ 541.8). ATAHSKIA files relief requests with the gate calendar and hold history attached and, if the billing party does not resolve the request within 30 days, compiles a 46 U.S.C. § 41310 charge complaint for the billed party to submit.
